Suppliers of an unsafe product prosecuted by Hull City Councils Trading Standards - 02/08/2012
An unusual and significant prosecution has been brought against three companies forming a complete supply chain and ordered to pay a total of £10,325 in fines and costs for supplying an unsafe teeth whitening kit.
Following a complaint from a local resident, Hull City Council's Trading Standards carried out an investigation into the supply of the product, described as being a 'professional home kit'. Concerns were raised by the consumer when her clothes were stained whilst using the product, which had been given to her by her dentist as part of her treatment.
The investigation which included an analysis of the whitening agent revealed that the products bleaching ingredient, hydrogen peroxide was approximately 10 per cent, almost 100 times greater than that permitted under safety regulations.
All three defendants pleaded guilty to an offence under the Cosmetic Products (Safety) Regulations 2008. At Hull Magistrates Court on 23 March, the importing company, Wyten Technology Limited was fined £2,000 and ordered to pay £2, 500 in costs and a £15 victim surcharge and the distributor, Billericay Dental Supply Company Limited was fined £1,500, costs of £2,500 and a £15 victim surcharge. The court also ordered the destruction of the stock which was found at the distributors premises.
At Hull Magistrates Court on 19 July, the local dentist based on Freetown Way, Hull, Kasbin Limited trading as My Dental Health Club was given a conditional discharge and ordered to pay £1,795 in costs.
Councillor John Hewitt, Portfolio Holder for Neighbourhoods and Communities, said:
"This is a rare case and without the complaint of the resident this prosecution of the whole supply chain may not have taken place.
"Our role is all about protecting the public, businesses have to act responsibly and have a legal duty of care to the public. This case shows that businesses will face the consequences when they fail to do so."
