Local business fined for not providing information on Business Waste Contract - 16/04/2012
A local business has been prosecuted for not providing information relating to their commercial waste.

Kingston Car Sales (Lorryhall Ltd), Newland Avenue, was approached by Hull City Council as part of the citywide Waste Contract Audit to confirm the business had an appropriate waste contract in place. Hull City Council made several attempts to work with the business who failed to provide the information.

A statutory notice was served on Kingston Car Sales (Lorryhall Ltd), Newland Avenue, to provide information within seven days for the last two years proving that transfer notes or bins and a registered waste contract are in place. The business failed to supply the information on 12 July 2011 and a fixed penalty notice was served and the business was fined £300.

Kingston Car Sales (Lorryhall Ltd), Newland Avenue failed to pay the fixed penalty notice.

The Company Secretary of Lorryhall Limited trading as Kingston Car Sales failed to attend Hull Magistrates Court on 27 January 2012, the case was proved in their absence and was fined of £1,000, costs of £325 and a victim surcharge of £15 (total £1,340).

Justine Mortimer, Neighbourhood Nuisance Manager, said:

"Businesses are unable to use residential waste collections and household recycling centres to dispose of their rubbish, and have a duty of care under the Environmental Protection Act 1990 to keep their waste safe and disposal of commercial waste. We can provide advice to businesses to help them deal with their waste by calling 01482 300 300, visiting www.hullcc.gov.uk or emailing wastemanagement@hullcc.gov.uk

"If you witness an illegal waste carrier you can report them to Hull City Council on 01482 300 300, www.hullcc.gov.uk or email enviro.crime@hullcc.gov.uk."
