Local business fined #4,500 for food safety and health and safety offences - 05/04/2012
A local retailer has been fined £4,500 plus costs and found guilty of food safety and health and safety offences at Hull Magistrates Court.

Mr Michal Mikolojcuk, formerly of Grosik Polish Supermarket, Newland Avenue pleaded guilty to offences of removing detained food products from the premises without the authorisation of Hull City Council and storing high sensitive food above the maximum legal temperature.

In addition, Mr Mikolojcuk pleaded guilty to failure to prevent access to the rotating blades of the two food slicers at the premises by not having adequate guarding which had resulted in an employee cutting her right index finger. He also pleaded guilty to not providing adequate training to his workers when using this equipment. There was also two offences of electrical equipment and installation being sub standard and dangerous.

Hull City Council's Environmental Health Officers carried out a routine inspection of Grosik on the 3 May 2011. An amount of cooked meat was formally detained pending further investigation as required by food hygiene legislation. A Detention of Food Notice was served prohibiting the food from being moved from the place of detention without specific authorisation from the Council. Mr Mikolojcuk ceased trading at the premises shortly after the inspection.

Hull Magistrates Court found Mr Mikolojcuk guilty on Tuesday 20 March 2012 and was fined £2,000 for the food safety offence, £2,500 for health and safety offences, ordered to pay £1,900 costs, and a victim surcharge of £15.

Garry Kitching, Hull City Council's Food, Health and Safety Manager, said:
"This case shows that routine inspections by Environmental Health Officers and any subsequent action taken are imperative to protect public health and workers. A clear intention was demonstrated by the Food Business Operator to remove the detained food products that were potentially a risk to health. The Council will not hesitate to pursue formal action where serious breaches are witnessed.

"As this case demonstrates, health and safety laws apply to all businesses, no matter how small, complying with them is not necessarily difficult or complicated. Businesses need to take sensible precautions to reduce the risks of workplace dangers and provide a safe working environment."
