Business prosecuted for not responding to information regarding fly tipping incident - 03/04/2012
A Hull business has been prosecuted and fined £525 plus costs for not providing information regarding a fly tipping incident on Spring Bank.
Evidence in the form of a letter was found in a skip on Spring Bank West in September 2011 that identified Kiet Kim, trading as Oriental Chef on Princes Avenue as the owner of the information that had been fly tipped.
Hull City Council served a Environment Act 1995 section 108 notice on Kiet Kim on 31 October and failed to respond and provide information.
Mr Kim failed to attend Hull Magistrates Court on 9 March 2012 and was found guilty in his absence of section 110 of the Environment Act 1995. Mr Kim was fined £525, costs of £441 and a victim surcharge of £15.
Justine Mortimer, Hull City Council's Neighbourhood Nuisance Manager, said:
"I hope this case highlights that the Council will investigate any reports of fly tipping and we will take action against those who do not supply information and comply with legislation.
"Businesses have a duty of care in how they dispose of waste, fly tipping poses a risk to human health, wildlife and the environment."
