Disagreeing with a decision about your housing benefit or council tax reduction 

If you do not understand the housing benefit or council tax reduction decision you can ask for a detailed statement as to how we have made the decision(s).

What to do if you think the decision about your housing benefit and/or council tax reduction is wrong -

  • you can ask us to reconsider the decision(s)
     
  • you can make a formal appeal against the decision(s)

You can ask us to reconsider both decisions again, but if you wish to make a formal appeal different rules apply.

For housing benefit

  • If you would like us to look at the decision again you must write to us within one calendar month of the date of the decision. We will write to you to inform you of the outcome of our reconsideration
     
  • If you would like to make a formal appeal against the decision or the reconsideration decision, you must write to us within one calendar month of the date of the decision. We will reconsider the decision and if it cannot be changed in your favour we will pass it directly to the independent Tribunals Service

Please note - You do not have to ask us to reconsider your decision before you make a formal appeal, however we would recommend that you ask us to reconsider it first.

 
For council tax reduction  

  • If you would like us to look at the decision again write to us within one calendar month of the date of the decision. We will write to you to inform of the outcome of our reconsideration

Please note - You can make a formal appeal against the decision, but you must ask us to reconsider it first.

  • If the outcome of our reconsideration is that we cannot change the decision in your favour and you want to make a formal appeal you must write to the independent Valuation Tribunal within two months of the date of our reconsideration decision
     
  • You can make a formal appeal to the independent Valuation Tribunal if you have not heard anything from us within two months of the date you asked us to reconsider the decision.  You must write to the independent Valuation Tribunal within four months of the date of your original reconsideration request

Asking for a statement or for us to reconsider the decision about your housing benefit and/or council tax reduction does not take away your right to submit an appeal
