Environmental Information Regulations

The Environmental Information Regulations allow people to request environmental information from public authorities and organisations carrying out a public function.

Any request for information held by or on behalf of a public authority or an organisation carrying out a public function is technically a Freedom of Information (FOI) request in the first instance. However if the information requested relates to the environment it will be dealt with under the Environmental Information Regulations 2005.

The regulations require that information is provided within 20 working days, however this deadline can be extended to 40 working days where the request is both complex and a large amount of information is required.


In some circumstances public authorities do not have to provide the information requested and can use one or more of the exceptions to withhold information.


Public authorities are entitled to charge for complying with information requests as long as the amount is ‘reasonable’. The charge must not exceed the cost of producing the information. A charge cannot be made for allowing people to -

  • access any public register or list of environmental information, or
  • examine the information requested at the place which the public authority makes available for that purpose
