Air quality controls

Planning and development control

We comment on planning applications with regard to any potential effects on air quality.  Developments that have the potential to have a detrimental impact on air quality and, in particular, development requests in an area which is currently an air quality management area may require an environmental impact assessment.

We are currently in the process of writing guidance for developers so that what we require is more clearly understood.  Once it is complete, the guidance will be available to download here.

Integrated pollution and prevention control (IPPC)

We also have the responsibility for regulating and controlling certain industrial activities that have the potential to pollute the air. These range from large and complex processes, such as crematoriums and iron foundries to petrol vapour emissions from petrol filling stations when fuel is delivered.
Under the IPPC regime there are three classes of activities -

  • Part A(1) processes will be regulated by the Environment Agency and subject to the full IPPC regime. They will comprise of processes previously authorised as Part A in the old regime, with the new additions of waste disposal and food and farming.
  • The majority of Part B processes will remain as Part B permits regulated by the Local Authority with control over only emissions to air.
  • A new category of Part A(2) processes has been created whereby these previously Part B processes would remain under Local Authority regulation but have to meet the full requirements of the IPPC regime. The A2 permits will cover controls such as air, water, noise, energy efficiency and site restoration.

Currently 112 processes are included within the public register.
