Smoke from a chimney serving industrial and trade premises

Most of Hull has been declared a smoke control area with the exception of a few small areas. It is illegal to emit any smoke from a chimney serving industrial or trade premises in a smoke control area.

The term chimney includes chimneys serving furnaces, fixed boilers or industrial plant, whether they are attached to buildings or not. Industrial or trade premises include -

  • the site where you are working, such as a building or demolition site
  • any site that you own or lease
  • land used for commercial agriculture or horticulture

Smoke from chimneys of industrial and trade premises NOT in the smoke control area 

Ringelmann chartIf your industrial or trade premises is not in a smoke control area, then you may emit smoke from the chimney, but it must not be ‘dark smoke’.

It is an offence to emit ‘dark smoke’ from a chimney that is not in a smoke control area subject to the conditions below. ‘Dark smoke’ is defined as smoke as dark as or darker than shade 2 on the Ringelmann Chart.

The law takes account of starting the appliance and putting more fuel in (charging) the appliance and for soot blowing. They allow certain periods for the emission of dark smoke from chimneys.

For industrial or trade premises, these are -

Number of furnaces Aggregate in any eight hour period without soot blowing Aggregate in any eight hour period with soot blowing
1 10 mins 14 mins
2 18 mins 25 mins
3 24 mins 34 mins
4 or more 29 mins 41 mins

  • no more than 10 minutes in total over any 8 hour period
  • no more than four minutes continuously (other than by soot blowing)
  • no more than two minutes in total over any 30 minute period

It is illegal to emit any smoke from a chimney serving industrial or trade premises in a smoke control area. There are some exceptions which are explained later in this page.

There are some appliances that have passed tests to allow them to be used in industrial or trade premises in smoke control areas so long as they burn certain fuels in specified ways. These are known as exempt appliances.
